Terms of use

1. Purpose and acceptance

These General Terms of Use (hereinafter the “Terms”) govern access to and use of the MORYA platform, available at morya.app (including MORYA Research, morya.app/research), invest.morya.app, home.morya.app, pilot.morya.app, radar.morya.app and stay.morya.app, as well as the associated browser extension and mobile apps.

By creating an account or using the MORYA services, you accept these Terms of Use without reservation. If you do not accept these terms, you must not use the platform.

The terms of sale of subscriptions and purchases (price, duration, termination, right of withdrawal, mediation) are set out in a separate document: the terms and conditions of sale. In the event of a conflict on a point relating to the sale, the Terms and Conditions of Sale prevail.

2. Description of the services

MORYA is a property intelligence platform made up of complementary modules:

• MORYA Invest: rental yield analysis, price estimation, property listing search, tax calculation, browser extension to analyse listings in real time.
• MORYA Home: home staging by artificial intelligence. Upload of room photos, generation of furnished images, furniture purchase recommendations.
• MORYA Pilot: management of rental property portfolios. Tracking of properties, tenants, tenancy agreements, rent receipts, accounting, legal documents and tax exports.
• MORYA Stay: short-term rental management software (channel manager) — bookings, calendars synchronised with booking platforms, pricing, stay tracking, and a direct booking page whose payments are collected by the host on the host's own Stripe account. MORYA Stay is also governed by specific terms and a data processing agreement.
• MORYA Radar: professional property prospecting. Identification of off-market opportunities from cross-referenced public data (BODACC, INPI, cadastre, DVF).
• MORYA Research: an observatory of public real estate data, town by town (prices, rents, energy performance, demographics), freely accessible without an account. Its figures are provided for information purposes only.

3. Registration and user account

Apart from MORYA Research and the free tools, which are freely accessible, access to MORYA services requires creating a user account. A single account gives access to all the platform’s modules through single sign-on (SSO).

You undertake to:

• Provide accurate and up-to-date information when registering.
• Keep your login credentials confidential.
• Notify MORYA immediately of any unauthorised use of your account.
• Not create multiple accounts for the same person.

You are responsible for all activity carried out under your account. MORYA cannot be held liable in the event of fraudulent use of your credentials.

4. Conditions of use

By using MORYA, you undertake to:

• Use the platform in accordance with its intended purpose and with the laws in force.
• Not attempt to circumvent the platform's security measures.
• Not use robots, scripts or automated tools to access the services, except via the features provided for this purpose (official browser extension).
• Not reproduce, copy or resell all or part of the service without authorisation.
• Not use the data provided by MORYA for unlawful purposes or purposes contrary to public policy.

Any breach of these obligations may lead to the suspension or deletion of your account, under the conditions set out in Article 10.

5. Intellectual property

All the elements making up the MORYA platform (source code, graphical interface, trade marks, logos, texts, algorithms, artificial intelligence models) are the exclusive property of MORYA or of its licensors.

Any unauthorised reproduction, representation, modification or exploitation of these elements is strictly prohibited and constitutes an infringement punishable under the French Intellectual Property Code.

6. User data and content

You retain ownership of all data and content that you submit to the platform (photos, documents, portfolio information). By using MORYA, you grant the platform a limited, non-exclusive licence to process this data for the sole purpose of providing you with the services requested.

You are solely responsible for the content you upload. You warrant that you hold the necessary rights to the photos and documents submitted.

The processing of personal data is governed by our Privacy Policy. Certain processing operations involve sending your content to providers located outside the European Union: this is the case for photos submitted to MORYA Home. The privacy policy details which ones and under what conditions.

6 bis. Images generated by MORYA Home

The images produced from your photos belong to you. You may use them freely, including commercially: listings, property portals, brochures, social networks. We claim no rights over these renders and do not reuse them — neither to illustrate our website nor to train a model.

Two reservations, which protect you as much as they protect us:

• A render is not a photograph of the property. It shows a possible layout, not the actual condition of the premises. Presenting a generated image as a photo of the property as it is would constitute a misleading commercial practice within the meaning of Article L121-2 of the French Consumer Code — responsibility for which would lie with the person publishing the listing.
• Disclose it. The European regulation on artificial intelligence requires that content generated or modified by AI be indicated as such. A notice such as “AI-generated visual — suggested layout” is sufficient, and it is also what property portals expect.

Two images generated from different photos may look alike: a model produces variations, not unique works. We therefore guarantee no exclusivity over a render, and you cannot claim its originality against a third party who obtains a similar result.

7. Service availability

MORYA endeavours to ensure the availability of the platform 24 hours out of 24, 7 days out of 7. However, MORYA does not guarantee uninterrupted availability and cannot be held liable in the event of:

• Interruptions for maintenance, updates or technical improvements.
• Outages or malfunctions beyond our control (hosting provider, network, etc.).
• Force majeure events.

MORYA reserves the right to temporarily suspend access to all or part of the services for maintenance reasons, endeavouring to inform users in advance.

These provisions are without prejudice to the legal guarantee of conformity owed to consumers in respect of digital services, described in the terms and conditions of sale.

8. Liability and warranties

The information provided by MORYA (price estimates, rental yield calculations, tax analyses, market data) is given for information purposes only and in no way constitutes investment advice or a legal or tax opinion.

To the extent permitted by law, MORYA cannot be held liable for:

• Investment decisions made on the basis of the information provided.
• The accuracy, completeness or currency of data from third-party public sources (DVF, DPE, cadastre, listings).
• Results generated by artificial intelligence (home staging, estimates).
• Direct or indirect financial losses related to the use of the service.

No provision of these Terms of Use has the effect of excluding or limiting the liability of MORYA in the event of wilful misconduct (dol), gross negligence or personal injury, nor of excluding the rights that the law mandatorily grants to consumers.

You are advised to consult a qualified professional (notaire, chartered accountant, wealth management adviser) before making any property investment decision.

9. Subscriptions and payment

Some modules and features are available free of charge, others on a paid subscription. Details of the plans, prices in euros inclusive of all taxes, durations, trial periods and payment terms are set out in the terms and conditions of sale, as well as on the pricing page of each module.

MORYA is the seller of the subscriptions. Payments are processed by Stripe Payments Europe, Ltd. as payment service provider. Subscriptions taken out from an iOS application are sold by Apple under the App Store terms.

10. Termination

You may cancel your subscription at any time, without giving reasons and free of charge, under “Cancel my subscription” in your account settings. This function is permanently accessible, through the same interface as the one used to subscribe. Subscriptions taken out from an iOS application are cancelled from the subscription settings of your Apple account.

Termination takes effect at the end of the current billing period: you retain access to the service until that date and no further payment is taken thereafter.

This right of termination is without prejudice to your right of withdrawal of fourteen days, to refunds due in the event of withdrawal or of a failure to provide information on tacit renewal, and more generally to any refund provided for by law. These rights are set out in the terms and conditions of sale.

You may also delete your account at any time, including when you have no paid subscription.

MORYA reserves the right to terminate your account in the event of a breach of these Terms of Use, after notification by email and, except in the case of a serious breach or a breach that cannot be remedied, after allowing you a reasonable period to remedy it. In the event of termination at MORYA's initiative without any breach on your part, the sums paid for the period not provided are refunded to you on a pro rata basis.

Upon termination, your personal data will be deleted in accordance with our Privacy Policy, subject to legal retention obligations.

Only one free trial is granted per person and per module, and a given payment card can open only one per module: if it has already been used for a MORYA trial, the subscription starts immediately, with no trial period. To prevent it from being obtained more than once, after your account is deleted we keep an irreversible fingerprint (from which the data cannot be recovered in clear) of your email address and, where applicable, of the payment card used, linked to the module concerned, for no more than three years. Legal basis: our legitimate interest in preventing fraud.

11. Amendments to the Terms of Use

MORYA reserves the right to amend these Terms of Use at any time. In the event of a substantial amendment, users will be informed by email or by an in-app notification at least 30 days before the new terms come into force.

Continued use of the platform after the amendments come into force constitutes acceptance of the new Terms of Use. If you disagree, you may terminate your subscription or your account in accordance with the terms of Article 10.

12. Governing law and jurisdiction

These Terms of Use are governed by French law. In the event of a dispute relating to the interpretation or performance of these Terms of Use, the parties will endeavour to find an amicable solution.

If you are a consumer, you may use, free of charge, the consumer mediator whose details are set out in the terms and conditions of sale and on the legal notice page, and you may bring proceedings before the court of your place of residence. Failing an amicable resolution, the dispute falls within the jurisdiction of the French courts.
