Tenancy agreements and documents

The tenancy agreement fills itself in from the file, not from a blank page.

A tenancy agreement comes down to a duration, a regime and a bundle of annexes. Getting any one of the three wrong does not show at signing: it shows at the notice to quit, at the review, or in front of the judge. Pilot starts from the property, the tenant and the regime you chose, and fills in what follows from them.

The wrong type of tenancy agreement cannot be corrected along the way.

The term, the notice, the right to review, the conditions for giving notice and even the tax regime all follow from the type of contract signed at the outset. A furnished home let under an unfurnished tenancy agreement finds itself committed for three years instead of one; a bail mobilité signed with a tenant who does not meet its conditions is requalified, and requalification never works in favour of the party who drafted it. Pre-filling is therefore not about saving typing time: it is about making the term, the annexes and the mandatory statements consistent with the regime, because it is that consistency that will be held against you.

  • Eight types of lease pre-filled from the property and tenant data
  • Commercial 3/6/9 and professional lease: ILC, ILAT or ICC index, VAT, quarterly instalments
  • Mixed-use lease, garage lease and temporary occupancy agreement as well
  • Annexes listed: surveys, information notice, recoverable charges
  • Amendments, furniture inventory and guarantee deed can be generated

In practice.

  1. You choose the regime, not a file

Unfurnished, furnished, student furnished, mobility, seasonal, flat-share, commercial or professional letting. Each choice determines a different duration, notice period, review index and set of appendices — and Pilot does not let you generate a lease whose type contradicts what you have declared about the property.

  2. The tenancy agreement fills itself in from the file

Identity and address of the landlord, description of the property and its floor area, the tenant and guarantor if any, rent excluding charges, advance payments, deposit, dates. None of this is re-entered: it is the property and tenancy data, the very data that will then feed the payment schedule and the receipts.

  3. The statements that depend on the context are in place

Rent control zone where applicable, review terms with the reference quarter, method for allocating charges. These statements are not decorative: the annual review and the year-end reconciliation will rest on them.

  4. You review, then the PDF is produced and archived

A preview is available before generation. The document goes into the tenancy file, with the inventory report and the rent receipts to come — not into a downloads folder.

  5. A house share is treated as several tenants

A flat-share lease has not one signatory but as many as there are flatmates, each with their rank, their share and their possible move-out date. That is what makes it possible to follow a joint liability clause instead of mentioning it without ever knowing whom it still binds. Prefer one lease per room? Each room becomes a unit, with its own lease and instalments.

What it changes

The term and the notice follow the regime

Three years for an unfurnished tenancy with an individual landlord, one year furnished, nine months for students with no tacit renewal, one to ten months for a bail mobilité with no renewal. These durations are not settings: they are attached to the type you chose.

The tenancy agreement feeds everything else

Payment schedule, rent notices, rent receipts, review anniversary date, the index’s reference quarter: everything flows from the tenancy agreement. A tenancy agreement entered properly once saves a year of manual corrections.

The annexes are not forgotten

The technical survey file, the information notice and, in a jointly owned building, extracts from the building regulations must be attached. Pilot reminds you of them and attaches them to the file — the missing annex is the most ordinary and most expensive flaw.

The law, and the pitfalls

The tenancy agreement for an unfurnished or furnished home that is the tenant’s main residence must follow a standard contract set by decree, and contain the statements it provides for.

art. 3 of Law No. 89-462 of 6 July 1989; Decree No. 2015-587 of 29 May 2015

The standard contract is not a recommended template: it is a framework. A clause that contravenes it is deemed unwritten, which means it is not applied — but the rest of the tenancy agreement stands. The landlord therefore finds themselves bound by a contract stripped of the clause they cared about.

The bail mobilité is reserved for tenants who can show, on the start date, that they are in training, studying, on an apprenticeship, on an internship, on voluntary service, on a work transfer or on a temporary assignment.

art. 25-12 et seq. of Law No. 89-462, introduced by the loi ELAN of 23 November 2018

No deposit may be requested on a bail mobilité (short-term mobility lease), and the contract is neither renewable nor extendable. Signed with a tenant who does not meet the conditions, it risks being requalified as an ordinary furnished lease — with its one-year term and the tenant’s right to remain in the property.

The technical survey file must be annexed to the tenancy agreement when it is signed, EPC included.

art. 3-3 of Law No. 89-462

A missing or expired EPC is not just a missing annex: the home’s rating now determines the right to increase the rent and, for the lowest ratings, the right to let it at all. The survey is no longer a formality at signing; it is a document that decides.

A guarantor who is a natural person must precede their signature with a statement written out in their own hand, on pain of nullity of the guarantee.

art. 2297 of the French Civil Code (Ordinance No. 2021-1192 of 15 September 2021)disputed point

A statement pre-printed in a template does not meet this condition. The guarantee is then void, and it is void at the very moment it should have served: when the tenant stops paying. That is why the guarantee deed Pilot generates leaves the statement area blank, to be filled in by the guarantor’s own hand.

What Pilot refuses to do

  • We do not pre-fill the guarantor’s handwritten statement

The guarantor must write it themselves. A template that already contains it produces a void guarantee — a guarantee that evaporates the day you need it. The deed Pilot generates reproduces the text of article 22-1 and leaves the statement area blank.

art. 2297 of the French Civil Code

  • We do not claim our templates are certified

They follow the standard contract and its mandatory statements, and they are pre-filled from your data. That is not the same as validation by a legal professional, and we will not write that until it is the case.

  • We do not apply your scanned signature to a tenancy agreement

A pasted image is not a signature: it binds no one. On a receipt or a letter you issue alone, it is welcome; on a lease, an amendment or a guarantee deed, which record an agreement, it would suggest a consent that nobody gave.

Frequently asked questions

How many types of tenancy agreement are really pre-filled?

Eight: unfurnished, furnished, student furnished, mobility, seasonal, flat-share, commercial 3/6/9 and professional. Added to these are the mixed-use lease, the garage lease and the temporary occupancy agreement. The commercial lease carries its index (ILC, ILAT or ICC), VAT if you have opted for it — with a numbered rent invoice in that case — and its quarterly instalments.

Is the tenancy agreement compliant with the law?

It follows the regulatory standard contract and its mandatory statements, and it is pre-filled from your data. We do not write “certified” or “approved by a lawyer”: formal legal validation of our templates has not been done, and claiming it would be precisely the kind of assertion we refuse elsewhere.

Is the lease included from the first tier?

Yes. Creating a lease is part of the Essentiel tier, along with the tenant portal and messaging, and the trial — 7 days at launch, card required — gives access to everything. A landlord without a lease has no due dates, no rent receipts and no tenant to talk to: we do not sell the front door separately.

How is a house share handled?

Two ways. A single lease carries as many tenants as there are flatmates, each with their rank, their share and, where relevant, their move-out date: that is what makes it possible to follow the real reach of a joint liability clause. Or one lease per room: each room becomes a unit, and a reminder targets only the tenants of the lease concerned.

And the guarantee deed?

Pilot generates it, pre-filled from the tenancy agreement, with the text of article 22-1 of the law of 6 July 1989. The statement area stays blank: article 2297 of the Civil Code requires the guarantor to write it themselves, on pain of nullity — a pre-printed statement does not meet that requirement. It cannot be signed electronically with us.
