Tenancy agreements and documents

Thirty letters, pre-filled from the file.

What brings a letter down in litigation is almost never the tone: it is a missing mandatory statement, a wrongly stated ground or a wrong amount. Pilot takes care of all three, and leaves you the one thing software cannot do — deciding to send.

A badly reasoned notice to quit cannot be fixed: it has to be redone, six months later.

The three notices to quit a landlord can give — sale, taking back the property, legitimate and serious reason — have neither the same mandatory statements, nor the same effects, nor the same consequences if there is a mistake. A notice for sale must reproduce the first five paragraphs of a specific article and give the tenant a right of first refusal; a notice to take back the property must name the beneficiary and your relationship to them. A single template would produce three fragile notices instead of one solid one. And the cost of a void notice is not a letter to rewrite: it is a tenancy that carries on, a buyer who pulls out, a year lost.

  • Thirty distinct letters, because the mandatory statements differ
  • Amounts rebuilt from the payment schedule, never retyped
  • Preview before generation, then the PDF archived in the tenancy file
  • On your letterhead: logo, colour, and your scanned signature if you wish

In practice.

  1. You choose the legal act, not a generic template

Reminder, formal notice, repayment plan, service charge reconciliation, deposit refund, rent review notification, notices to quit — sale, taking back the property, legitimate and serious reason — but also works, boiler servicing, insurance, guarantor, managing agent, viewings, lease transfer.

  2. Pilot fills it in from the tenancy agreement

Landlord, tenant, description of the property, tenancy references and dates. On financial documents, the amounts are rebuilt instalment by instalment: accumulated arrears are not a sum you calculate, they are the total of what the database has recorded.

  3. The statements specific to the document are in place

The applicable notice period, the ground and the evidence supporting it, the articles to reproduce where the law requires it. That is the work nobody willingly redoes by hand, and the one where an omission is most expensive.

  4. You review before generating

A preview shows the completed document. We generate nothing before you have been able to read it: a legal letter produced without review is a letter whose content nobody stands behind.

  5. The PDF goes into the tenancy file

Dated, with the template it came from. The timeline builds up at the moment of the action, not on the day you have to rebuild it in front of a third party.

What it changes

Three distinct notices to quit, not one template to adapt

Because they are three different legal acts. Adapting a notice-to-quit-for-sale template into a notice to quit for taking back the property by changing two sentences produces an act missing the statements specific to the second.

The amount cannot be wrong

A wrong total in a formal demand gives the tenant grounds for dispute, and loses you the benefit of the letter. Rebuilding from the payment schedule removes re-entry, and therefore the error.

The record is worth as much as the letter

With unpaid rent, what matters in the end is not the last letter but what follows: what, when, to whom. Every generation is archived, so what follows exists.

The law, and the pitfalls

Notice given for sale must state the price and terms of the proposed sale, reproduce the first five paragraphs of the applicable text, and constitutes an offer to sell to the tenant.

art. 15 II of Law No. 89-462 of 6 July 1989

Failing to reproduce the text, or the price, makes the notice void. The tenant has a right of first refusal: selling to a third party at a price below the one notified without having offered that new price to the tenant puts the sale itself at risk.

Notice to take back the property must state the reason as well as the name and address of the person taking it back and their relationship to the landlord.

art. 15 I para. 3 of Law No. 89-462

A notice to quit for taking back the property that does not name the beneficiary is void, and a repossession that does not then take place may be regarded as fraudulent. The ground is not kept vague out of caution: vagueness is precisely the defect here.

The notice period for notice given by the landlord is six months for an unfurnished home and three months for a furnished home, and runs from receipt of the notification.

art. 15 I and art. 25-8 of Law No. 89-462disputed point

From RECEIPT, not from sending. A notice to quit posted on day 30 but presented on day 3 of the following month pushes the end date back by a whole month — and the date that counts is that of the first delivery attempt notice, not that of the actual collection of the letter.

The termination clause for non-payment only takes effect after a commandement de payer (formal order to pay) served by a judicial officer has remained unanswered for six weeks.

art. 24 of Law No. 89-462

No formal demand, even by registered post, replaces this commandement de payer (formal order to pay served by a bailiff) or starts this period running. Letters build the amicable phase; they do not start the procedure.

What Pilot refuses to do

  • We do not send these letters

Pilot drafts them, fills them in, generates them and archives them. Delivery — registered post with acknowledgement of receipt, service by a commissaire de justice (bailiff), hand delivery against signature — remains your responsibility, and it is delivery that produces the legal effects.

  • We do not provide a single notice-to-quit template

The mandatory statements differ, and their absence is penalised. Three separate documents are better than one template you adapt hoping you have not forgotten anything.

art. 15 I and II of the Law of 6 July 1989

  • We do not announce more than thirty letters

There are thirty pre-filled ones, and a safeguard recounts the files at every build: a page announcing more would make publication fail. Additional templates are presented for what they are — files to download and fill in yourself.

Frequently asked questions

Exactly how many letters?

Thirty, pre-filled from the tenancy data: reminders (rent, charges, insurance), formal notice, repayment plan, service charge reconciliation, deposit refund, rent review, separate notices to quit, works, breach of quiet enjoyment, guarantor, insurer, managing agent, lease transfer, end of joint liability. They are part of Pilot’s 55 pre-filled templates. An automatic check recounts the files at every publication, so this number cannot drift.

Why three notices to quit and not one?

Because the mandatory statements differ and their absence makes the notice void. A notice to quit for sale must reproduce a legal text and offer a right of first refusal; a notice to quit for taking back the property must name the beneficiary and their relationship to you.

Does Pilot send the letters?

No. It generates them and archives them in the tenancy file; you post them. For a notice to quit or a formal demand, it is the notification that produces the legal effects — and we have no contract with a postal operator.

Is the amount of arrears calculated?

Yes, rebuilt instalment by instalment from the actual payment schedule. A total retyped by hand in a formal demand is a dispute handed to the tenant.

And for the documents you do not pre-fill?

Additional templates are available to download — list of tenant repairs, list of recoverable charges, request for direct payment of housing benefit, among others. They are files you fill in yourself, and we present them as such. The commercial lease, the professional lease, the guarantee deed and the flat-share amendment are, for their part, generated and pre-filled.
